Terms of service
The terms for using Second Call's website and service: the free audit, the client dashboard, the campaigns we run for you, our guarantee and our text messages.
In these terms
Agreeing to these terms
These terms are between you and Second Call ("we", "us"). By using our website, applying, booking a free audit, signing in to the client dashboard or receiving our text messages, you agree to them and to our privacy policy. If you don't agree, please don't use the service.
If you agree on behalf of a business, you confirm that you're allowed to bind it, and "you" includes the business. You must be at least 18.
What we do
Second Call is a done-for-you service. We take a business's old leads, sort them by the consent each person gave, and work the list for 30 days with AI phone calls, texts and emails in the business's name. People who are still interested are booked onto the business's calendar, and the business sees every call, reply and appointment on its dashboard.
Every AI call says at the start that it's an AI and that the call is recorded. Calls are recorded and transcribed, and the client whose lead it was can play the recording and read the transcript.
The free audit is a 30-minute call where we look at your list and tell you the number of booked appointments we'd guarantee. It's free, and there's no obligation. We may decline to work with a business, for example when its leads weren't collected with the consent we need.
Your price, your guaranteed number, your start and any setup fee are set in your client agreement before you pay.
The guarantee
Before you pay, we set a number of booked appointments in 30 days, sized to your list, in writing. If we fall short, you get 100% of your campaign fee back: the money, not a credit and not more free work. A setup fee, if your agreement has one, isn't part of the campaign fee, and the guarantee doesn't refund it.
An appointment counts when a lead from your list books a specific time on your calendar and doesn't cancel within 24 hours.
The guarantee applies when all of these are true:
- Enough people we can contact: at least 1,000 past patients for a dental practice (2,500 if most were last seen 2–4 years ago), or 2,000 leads for a real estate team (4,000 if most are 2–4 years old)
- People from your own records, forms, ads or calls, with proof of permission for anyone we call
- About 10 open slots a week on your calendar
- The 30 days start when texting is approved and we have your list
- You call back the people we book
Your number is written into your agreement. The guarantee page shows how we size it.
Your responsibilities as a client
- Consent for every lead you upload. With each upload you confirm that every lead with a phone number agreed in writing to be contacted by your business by phone call, text message and email, including with automated technology and an AI voice; that they gave that consent to your business itself, not to another company that sold or shared their details; and that you can produce a record of each person's consent if asked. Leads without that consent get email only.
- No one who asked not to be contacted. Remove or mark anyone who asked you to stop, and give us your own do-not-call list.
- Accurate information. Your business's name, postal address, phone number, working hours and services, and the details of your list, must be true and kept up to date. Every email we send for you carries your postal address.
- Approved scripts. We contact your leads only with the call script, texts and emails you've approved. Tell us before anything changes that would change what they say.
- Do Not Call checks. Give us what we need to check your numbers against the National Do Not Call Registry before we call or text them.
- Opt-outs that reach you. If a lead asks you directly, by phone, email or in person, to stop contacting them, press "Stop contacting them" on their page in your dashboard, or tell us straight away.
- Follow-up. Call back the people we book, and keep your calendar and working hours current.
- Patient information. If you're a medical or dental practice, we sign a business associate agreement with you before you upload patient details.
- Your own legal duties. You stay responsible for your business following the laws that apply to it, including what your lead forms say and the consent they collect.
If a claim is brought against us because a lead you uploaded hadn't given the consent you confirmed, or because information you gave us was wrong, you'll cover our reasonable costs of dealing with it and any amount we have to pay because of it.
Your account
Each person on your team gets their own login. Keep passwords private, and tell us straight away if you think someone else has access. You're responsible for what's done with your account's logins, and the account owner can add and remove team members.
Acceptable use
Don't use our website or service to:
- upload leads that were bought, rented or shared with you, or anyone without the consent described above;
- contact anyone who has asked not to be contacted;
- send anything false, misleading, harassing or unlawful, or content the phone carriers don't allow, such as sexual content, hate speech, or promotion of illegal drugs, cannabis, tobacco or firearms;
- pretend to be someone else, or misrepresent your business;
- get into accounts or data that aren't yours, overload or probe the site, or copy, scrape or resell the service;
- use the website chat or voice demo to harass anyone, or to have our AI call anyone who hasn't agreed to it.
We may pause a campaign, suspend an account or refuse an upload if we believe these terms or the law are being broken, or if a phone carrier or one of our providers requires it. A campaign also pauses itself when a required check, such as the Do Not Call check, runs out.
Text message terms
Second Call text messages. We send texts in three cases:
- Business owners who book a free audit get a booking confirmation, a request to confirm, and reminders before the call, with the meeting link when the call is by video.
- Clients who add a mobile number for alerts get a text when one of their leads books, replies or asks to be called back.
- A client business's leads get a few texts over a 30-day campaign, in that business's name, asking whether they still need what they asked about and inviting them to reply to set up a time. These go only to leads whose consent the business has confirmed to us in writing.
- How you opt in
- Business owners tick the consent box when they apply or book on our website or in our chat. Clients add a mobile number for alerts in Settings. Leads give their consent to the business, for example with a box on its quote form. Consent isn't a condition of any purchase.
- How often
- Message frequency varies. A business owner who books an audit gets up to five texts for that booking. A lead gets up to four texts over a 30-day campaign. Client alerts depend on how many bookings and replies come in.
- Cost
- Message and data rates may apply.
- Stopping
- Reply STOP to any text to opt out. QUIT, END, CANCEL, UNSUBSCRIBE, REVOKE and OPT OUT work too. We may send one text to confirm, and then no more. On a campaign text, STOP also ends that campaign's calls and emails to you.
- Help
- Reply HELP for help, or email us at support@usesecondcall.com.
- Carriers
- Carriers are not liable for delayed or undelivered messages.
- Privacy
- Our privacy policy explains how we handle your number. We never sell mobile numbers, and never share them, or your consent to receive texts, with anyone for their marketing.
Fees and refunds
The free audit costs nothing. Your client agreement sets the campaign fee, any setup fee and when they're due. Refunds are made under the guarantee above, or as your agreement says.
Your data and our work
Your lead lists and your business's information stay yours. You let us use them to run your campaign and as our privacy policy describes. Our website, software, AI agents and materials belong to Second Call. Please don't copy or reuse them without our permission.
Other companies' services
Parts of the service run on other companies' systems: Twilio for texts and phone numbers, ElevenLabs for AI calls, Resend for email, Google for calendars, and Anthropic for our website chat. Their outages or rule changes can delay or stop calls, texts, emails or bookings. When you connect Google Calendar, Google's terms also apply.
What we don't promise
Apart from the written guarantee, we don't promise any particular number of appointments, sales or revenue. AI can make mistakes, such as mishearing someone or getting a detail wrong, which is why every call is recorded and you can read every transcript.

To the extent the law allows, the website and service are provided as they are and as available, without other warranties.
Limitation of liability
To the fullest extent the law allows, Second Call isn't liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data, arising from the website or the service. Our total liability for any claim about them is limited to what you paid us in the 12 months before the claim or, if you haven't paid us anything, $100. Nothing in these terms limits a liability that the law doesn't allow us to limit.
Suspending and ending
You can stop using the website at any time. How a campaign is paused or ended is set in your client agreement. We may suspend or close an account that breaks these terms. The parts of these terms that should naturally last, such as your consent promises, the limits on liability and governing law, still apply after an account closes.
Governing law
These terms are governed by the laws of the state where Second Call is based, without regard to its conflict-of-law rules. Disputes will be heard in the state or federal courts there.
Changes to these terms
We may update these terms. The date at the top shows the current version. We'll email clients about significant changes before they take effect. Using the service after a change means you accept it.
